1. Scope of Application
These Terms and Conditions (“Terms”) govern the use of the website and services offered by Machete Marketing Germany GmbH, operating under the name Scalable. By accessing or using our services, you agree to be bound by these Terms.
These Terms apply exclusively to business customers (B2B) within the meaning of § 14 BGB (German Civil Code). Consumers (§ 13 BGB) are not permitted to use our services.

3. Services Provided
Scalable.Design offers data-driven tools, strategy generation, and creative briefing services to help Amazon and eCommerce brands optimize product content. Services may include software features, downloadable materials, audits, or consulting services, depending on your plan or agreement.
4. User Accounts
To access certain features, you may be required to create a user account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
You agree to provide accurate and complete information and to notify us of any unauthorized use of your account.
5. Fees and Payment
Our services may be subject to subscription fees, one-time payments, or custom pricing. Fees are exclusive of applicable taxes and are due immediately upon invoicing unless otherwise agreed.
In case of default, we reserve the right to suspend access to the service until full payment is received.
6. Intellectual Property
All content, software, materials, and data provided through Scalable.Design are the property of Machete Marketing Germany GmbH or its licensors and are protected by copyright and intellectual property laws.
You may not copy, modify, distribute, or reverse-engineer any part of the platform unless expressly permitted.
7. Use Restrictions
You agree not to:
- Use the service for unlawful or deceptive purposes
- Attempt to disrupt or harm the technical infrastructure
- Access or scrape data outside intended use cases
- Resell or sublicense the platform without written consent
8. Availability and Changes
We aim to provide uninterrupted service but reserve the right to modify or temporarily suspend services for maintenance or upgrades. We may also update these Terms at any time. Continued use constitutes acceptance of any changes.
9. Liability
We are liable only for intent and gross negligence. For minor negligence, we are only liable in cases of breach of essential contractual obligations (cardinal duties), and even then limited to foreseeable damages.
Liability under product liability law, or for injury to life, body, or health remains unaffected.
10. Data Protection
Our handling of personal data complies with the General Data Protection Regulation (GDPR). For more information, please refer to our Privacy Policy.
11. Termination
Either party may terminate the contract with notice, unless otherwise agreed. In case of breach of these Terms, we may suspend or terminate access without notice.
12. Applicable Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for all disputes is Karlsruhe, Germany, unless another mandatory jurisdiction applies.
13. Final Provisions
If any provision of these Terms is or becomes invalid, the remaining provisions shall remain unaffected.
